Datuk Dr Jeffrey Kitingan has expressed disappointment over the decision of the Kota Kinabalu High Court which rejected the judicial review challenging the dissolution of the Sabah State Legislative Assembly (DUN) made by Yang Dipertua Negeri Tun Juhar Mahiruddin.

However, Dr Jeffrey who is the president of Parti Solidariti Tanah Airku (STAR) and the Tambunan assemblyman (ADUN) believes that his party will succeed at the Court of Appeal.

He said, it is a mandate that needs to be implemented before the state election (PRN) begins.

Dr Jeffrey was one of 33 assemblymen, including former chief minister Tan Sri Musa Aman, who applied for a judicial review for the dissolution of the Sabah state assembly on July 30.

"It is a bit disappointing. But I am confident that it will be successful in the appeal, which will be made in Kuala Lumpur.

"We will wait and see the decision in the Court of Appeal next week," he said when met by Astro AWANI representatives at the Kota Kinabalu Court Complex, here, today.

Commenting on STAR's readiness in facing the PRN, Dr Jeffrey said the party machinery is always ready.

"At the party level, we are ready," he said.

Earlier today, the High Court here rejected the application of the 33 ADUNs to obtain permission for judicial review of the Yang Dipertua Negeri's decision to dissolve the DUN on July 30.

Judicial Commissioner Leonard David Shim found that the second respondent in the case, Sabah Chief Minister Datuk Seri Mohd Shafie Apdal had acted in accordance with the Sabah Constitution in requesting the first respondent, Juhar, to dissolve the DUN.

In this regard, the 33 assemblymen have filed an appeal, according to their lawyer Tengku Fuad Ahmad.
