The final appeal of former Selangor Menteri Besar Dr Mohamad Khir Toyo today in the country’s appex court has been postponed to an undetermined date.

Federal Court corporate communications head Mohd Aizuddin Zolkeply said the postponement was due to several reasons which “cannot be avoided”.

Aizuddin told reporters this morning that he was informed of the decision today itself. He said a new date will be made known to the prosecution and defence later.

The appeal hearing could have seen Dr Mohamad Khir being sent to jail today itself following the guilty verdict passed by the Shah Alam High Court in 2011.

The former Sungai Panjang assemblyman was then found guilty of corruptly obtaining two pieces of land and a bungalow when in public office.

The High Court had imposed a 12-month jail sentence as well as the seizure of his property. However, a stay of execution pending his appeals.

In May last year, The Court of Appeal upheld the High Court decision, and Dr Mohamad Khir filed his appeal at the Federal Court.

Dr Mohamad Khir, 49, was Selangor Menteri Besar from 2000 to 2008.

He was charged in 2009 with corruptly obtaining for himself and his wife Zahrah Kechik, two lots of land and a house at No 8 & 10, Jalan Suasa 7/1L, from Ditamas Sdn Bhd director Shamsuddin Hayroni, at RM3.5 million - a lower price than the RM6.5 million Ditamas paid for it in 2004.

The offence was committed at the official residence of the Selangor Menteri Besar at Jalan Permata 7/1, Section 7, Shah Alam, on May 29, 2007.

He is the second state Menteri Besar to be convicted of corruption after the late Harun Idris who was found guilty in the 1970s.
