A cable installation worker was sentenced to six years jail by the Sessions Court here, Monday for stealing a RM5 prepaid top-up card and assaulting a shopkeeper.

The accused Rizal Yusof, 29, from Kampung Wakaf Zain, Tawang, Bachok, was found guilty by Judge Mohd Yusoff Yunus, who held that the defence had failed to raise a reasonable doubt on the case against him.

"The accused's defence is a mere denial and the court hereby sentences him to six years in jail effective from today," Mohd Yusoff said in his judgement at the end of the defence proceedings.

Rizal was jointly accused, with an individual still at large, of robbing Rosri Yusof, 41, of a prepaid RM5 top-up card and assaulting him at a grocery shop in Kampung Cherang, Jalan Dusun Raja on Jan 28 2012.

He was charged under Section 394 of the Penal Code and faced up to 20 years imprisonment and fine or caning.

The prosecution was conducted by deputy public prosecutor Ahmad Salam Yusof while Rizal Yusof was represented by lawyer Ahmad Nizam Mohamed.
