The Sessions Court here today set Oct 19 for mention of a case involving army pathologist, Colonel Dr. R. Kunaseegaran for unlawfully engaging in trade following the death of deputy public prosecutor Anthony Kevin Morais, the prosecutor in the case.
Judge Sabariah Atan set the date after deputy public prosecutor from the Malaysian Anti-Corruption Commission (MACC), Mohammed Heikal Ismail, who appeared for the prosecution, requested for a new date to study the case.
Lawyers Afifuddin Hafifi and Mohd Shafiq Ahmed Bazari, representing Dr Kunaseegaran , did not object to it.
Dr Kunaseegaran, head of the Pathologist Laboratory at the Tuanku Mizan Military Hospital, Wangsa Maju, however, was not in court today.
He faced two charges for unlawfully engaging in trade while serving as a civil servant, in his capacity as the pathologist expert at the hospital.
The offence was allegedly committed at Clinipath (Malaysia) Sdn Bhd, No: 23, Galeri Empire, Jalan Empayar, Off Persiaran Sultan Ibrahim KU1, Klang near here from April 9, 2010 to April 8, 2011 and from April 9, 2011 to Dec 31, 2011.
Dr. Kunaseegaran, 52, had pleaded not guilty to both charges, made under Section 168 of the Penal Code, which carries an imprisonment for up to a year or with fine or both, if found guilty.
The court had set today for decision on an application by the prosecution for the case to be heard jointly with another case, also for a similar offence, facing the doctor in another Sessions Court.
The charge was for unlawfully engaging in trade while serving as a civil servant at Genomed Sdn. Bhd., Third Floor, Galeri Empire, Jalan Empayar off Persiaran Sultan Ibrahim KU1, Klang on Jan 1, 2012.
Kevin, 55, went missing on Sept 4 while driving to his office in Putrajaya from his condominium in Menara Duta here in a Proton Perdana car bearing registration number WA6264Q.
His body was found stuffed in a concrete-filled drum in Subang Jaya near here on Sept 16.
A suspect in the case, earlier classified as abduction, brought police to the location at Persiaran Subang Mewah in USJ1.
